RESIDENCY TERMS & CONDITIONS
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “art resident”, “resident”, ‘guest’, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “Water & Rock”, “Water & Rock art residency”, "The residency", “Ourselves”, “We”, “Our” and “Us”, refers to our Company Leah-Ellen Heming trading as Water & Rock. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. “The Property” refers to Water & Rock's buildings (house, garden, car) . Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
Purpose of the property
Mixed professional and residential use
List of premises, parts, equipment and accessories of the building for common use include:
Living room, kitchen, bathroom, musical instruments, garden furniture, art studio, entrance halls, laundry room, games, garden, outdoor terraces.
Equipment for access to information and communication technologies:
Internet wifi network
Booking conditions
A video interview will be arranged prior to booking confirmation.
We reserve the right to refuse or to accept bookings in our absolute discretion.
The booking at Water & Rock is considered confirmed, when we receive a deposit payment and send a written confirmation of the reservation via email.
Invoices are issued on booking confirmation after payment of a deposit (50% of the total amount) or after the payment has been made in full. The deposit is necessary to confirm the booking. Full payment (the remaining 50%) is due upon check in.
Financial Conditions
Your booking will be confirmed once we have approved your residency application and you have paid a 50% deposit of the total amount due for your residency.
A tax deductible invoice will be provided upon request.
The following 50% will be paid 2 days following your arrival.
Any extra excursions, car journeys, laundry, etc will be charged extra and invoiced at the end of your stay. We will have a spreadsheet that we can both fill out during your stay to keep tabs of extra expenses and amounts.
The residency fees includes:
• accommodation
• regular fresh bed sheets and towels (personal laundry not included)
• free wood in the winter months (to be used within reason)
• electricity
• water
• wifi
• pick up to and from the Thassos ferry port to the residency
• 1 weekly excursion day
• any other included excursions indicated on the particular residency that is chosen (see individual residency program for details)
• regular cleaning of the communal and bedroom spaces
• property maintenance
• garden maintenance
• car maintenance
Cancellation policy
The deposit is non refundable.
Unless prior arrangement, if the guests decides to leave the residency earlier than scheduled, a payment of the full residency is required.
In case of no show, a payment of the full residency is required.
If the guest cancels the booking 10 days or less prior to arrival date, a full payment is required.
Water & Rock reserves the right to terminate the residency with no reimbursement, if the guest is abusive, rude or intolerant to other guests, hosts and locals or disrespects the terms and conditions or the residency.
Damages
Water & Rock art residency accepts no responsibility for any loss, theft, or damage to persons or personal property during their stay. In case of damage or theft that a guest causes to the property (this includes the house, garden, car and other residents' property), they will be held responsible and required to reimburse us (or the other guest) for the amount of the damage.
In such case, Water & Rock will send an invoice that must be paid within 30 days upon reception. If you notice damage in your room it must be reported within the first 24h after arrival, alternatively, it will be automatically assumed that the damage was made by the guest and it will be added to their final bill.
In case of damages in the shared areas the guests are obliged to take one of the following actions:
Travel documents
It is the guests’ responsibility to ensure that they have the correct visas and other appropriate travel documents for entry into Greece. All costs incurred in obtaining such documentation must be paid by the guest. We regret we cannot accept any liability if the guests are refused entry onto any transport or into the country due to failure on their part to carry all required documentation. If failure to have any necessary travel or other documents result in fines, surcharges or other financial penalties or expenses being imposed on or incurred by us, guests will be responsible for reimbursing accordingly.
Insurance
The Water & Rock art residency house has contents insurance and third party liability insurance, but it is the guests' responsibility to have relevant travel & medical insurance.
Accidents, injuries or death
The artist resident will have a valid travel insurance that covers you for loss for unforeseen circumstances or accidents; such as illness, family emergencies, car accidents, accidents in nature, food poisoning or allergies, sickness. or other situations that may affect your travel plans.
Water & Rock cannot be held responsible in case of injuries, accident or death happening on the property (house, garden) or during an excursions/activities outside the property. Any injuries, accidents or death that occur during the stay at Water & Rock art residency has to be covered by the guest’s personal insurance or expenses.
Access
The property is difficult of access. You cannot drive to the property. You must walk 3 to 5 minutes up a steep, uneven stone path and steps to reach the property.
Unfortunately due to the location of the residency, people who depend on the daily use of a wheel chair or need assistance in walking will not be able to reach the property. If you have any concerns or questions regarding access and ability needs, please contact us.
Children
We do not accept children at the Water & Rock art residency.
Pets
At this moment, we do not allow pets owned by the artist residents on the property. We currently have 4 friendly cats on the property who have access to the inside of the house.
Natural disasters
Water & Rock art residency cannot be held responsible for any damage caused by natural causes or disasters. This includes water damage, wind damage, fire damage, storm damage, earthquakes, 'acts of God' to any personal belongings on or outside the property.
Travel
We will advise you on the best way possible to reach the property but we cannot be held responsible for any missed flights, public transport, strikes or hotel expenses because of any of the prior.
By accepting to take part in the residency program, you agree to:
• no illegal drug use allowed on the property
• respect the local laws and restrictions such as fire bans, water use, drug laws, etc
• respect other peoples' faith, beliefs, sexuality, ethnic background, gender pronouns - Water & Rock is a non-discriminatory and safe space for BIPOC, LGBTQIA+, and non-neurotypical people
• strictly no violence, harassing, abuse
• respect peoples' privacy and ask their consent before posting social media pictures of them or their work
• abuse the use of water,electricity. fire wood - we are an eco-friendly organisation
• only use ecological products during your stay on the property (sunscreens, soaps, shampoos, laundry detergent, insect repellents)
• respect the surrounding nature (no rubbish dumping, cigarette butts, wet wipes)
• no smoking inside the house, smoking is permitted on the terraces but not in the garden due to fire risk
• no smoking in the forest or in nature, smoking poses a very real fire risk
• listen to your host's safety instructions in case of a natural emergency or disaster (earthquake, fire, flood, storm, car accident)
• respect the local community and customs
• respect that the residency is a working space
• be mindful that you are sharing a space with other people with regards to noise
• let Water & Rock residency take pictures of you working and of your work for the promotion of the residency on social media and their website
• tag and mention the residency in their social media posts
• do not go on or engage with any illegal websites during your stay
Law
The artist residency is run under Leah-Ellen Heming, trading as Water & Rock registered in Greece, therefore, the agreement is held under Greek law, any objections or disputes must be resolved under Greek law.
YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THE TERMS OF USE, AND WILL BE BOUND BY THESE TERMS AND CONDITIONS. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS OF USE REPRESENT THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN US AND THAT IT SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN US RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.

Cancellation policy

- replace the item damaged or repair it, paying all the related costs
- cover the costs of the damage to Water & Rock
